§ 1 Scope and provider

These Terms and Conditions (T&C) apply to the use of the FamPrio platform (website and apps) by consumers within the meaning of § 13 BGB (German Civil Code). The provider is Max Bauer (sole trader), Freiherr-vom-Stein-Str. 4, 59558 Lippstadt, Germany, email: info@famprio.com.

§ 2 Formation of contract and free trial

Registration creates a usage contract for the free scope (Free plan). Without actively booking a Premium subscription, you stay on the free Free plan permanently. If you want to use Premium, you start a 30-day free trial. By starting the trial, you expressly agree that, after the 30 days end, it automatically converts into a paid Premium subscription at the chosen plan (monthly or yearly) unless you cancel beforehand. You are clearly informed of this automatic, paid conversion and the price due afterwards before the trial starts; you can cancel at any time — including during the trial.

§ 3 Family model, membership and invitations

Exactly one person per family group pays the Premium subscription (Family Owner). All invited family members get the same Premium feature set at no extra cost. One account can be the Family Owner of its own family and an invited member of other families at the same time, without being billed twice. The subscription covers use within one family group; a separate subscription is required for each additional independent family group with its own Family Owner.

Invitations can be sent by email or via a personal invitation link (e.g. through WhatsApp or other messengers). The invitation link can be used once and is tied to the inviting family group. When accepting the invitation, the invited person must use their own email address that is not yet registered with FamPrio.

Inviting minors – parental authority

Minors may only be invited by people who hold parental authority (parental custody or an equivalent right under § 1626 ff. BGB) for that minor. Anyone who invites a minor expressly confirms, by completing the invitation:

  • that they hold parental custody or an equivalent parental right for the invited child,
  • that, as the holder of parental responsibility, they give consent to the processing of the child's personal data in accordance with Art. 8 GDPR,
  • that they confirm the child's age entered in the app and are responsible for the accuracy of this information.

People without parental authority (e.g. grandparents, uncles, aunts) may only invite minors if they have first obtained the express written consent of the holder of parental authority. FamPrio is not liable for incorrect information given during the invitation process.

§ 4 Prices, payment and billing

The Premium subscription is available as:

  • Monthly subscription: EUR 3.99/month (total price; in accordance with § 19 UStG no VAT is charged/shown)
  • Yearly subscription: EUR 35.00/year (total price; in accordance with § 19 UStG no VAT is charged/shown)

Payment is made via Stripe Payments Europe Ltd. (web), Apple In-App Purchase (iOS) or Google Play (Android). Billing is in advance at the start of each billing period. Price changes are communicated by email at least 30 days before they take effect.

§ 5 Cancellation and automatic renewal

Subscriptions renew automatically for the booked period unless cancelled in time:

  • Monthly subscription: can be cancelled at any time, effective at the end of the current month.
  • Yearly subscription: can be cancelled at any time, effective at the end of the current contract year.

Cancellation is done in the app settings under „Manage subscription“ or via the management interface of the respective app store (Apple/Google). Cancellation by email to info@famprio.com is also possible.

When the cancellation takes effect, the family plan is downgraded to the free Free plan at the end of the paid period (main due date). If the number of family members exceeds the Free plan limit at that point, the Family Owner is required to choose themselves, before the downgrade takes effect, which members remain. If excess members are not removed manually in time, the system automatically reduces the number of members to the permitted limit by removing excess memberships without a separate selection. Content and data are retained; content exceeding the Free limit is merely frozen or made read-only until sufficient capacity is available again or you switch back to Premium.

§ 6 Right of withdrawal and withdrawal instructions

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (Max Bauer, Freiherr-vom-Stein-Str. 4, 59558 Lippstadt, Germany, email: info@famprio.com) by means of a clear statement (e.g. an email) of your decision to withdraw from this contract. You may use the model withdrawal form below, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your notice of exercising the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we will refund all payments we have received from you without undue delay and at the latest within fourteen days from the day on which we received notice of your withdrawal from this contract. For this refund we use the same means of payment you used for the original transaction; in no case will you be charged any fees for this refund.

If you requested that the service should begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the point at which you notify us of exercising the right of withdrawal, compared with the total scope of the services provided for in the contract. During the free 30-day trial no refundable amount arises.

§ 7 Adults community 18+

FamPrio operates the adults community exclusively for adults (18 and over). Age verification is done via the parent account: parents see the age entered by family members and confirm, by inviting them, that they know the age limits. People under 18 are prevented by the system from entering community areas, creating posts or receiving invitations to them. This age limit is based on § 1 (1) JuSchG, § 4 JMStV and the recommendations of the German Federal Agency for the Protection of Children and Young People in the Media.

§ 8 User obligations and rules of conduct

Users are obliged not to provide false information when registering, especially regarding age. The following content is prohibited in the family chat and the community:

  • Insults, threats and hate speech
  • Sexually explicit content or content harmful to minors
  • Discriminatory statements (under the AGG, German General Equal Treatment Act)
  • Content that infringes the rights of third parties (copyright, personality rights)
  • Spam, advertising and commercial offers without express permission

FamPrio uses automated content filters. Repeated or serious violations lead to the temporary or permanent blocking of the affected area or the entire account.

§ 9 Availability and changes to the service

FamPrio strives to provide the platform with availability of at least 99% per month but cannot guarantee this. Planned maintenance is carried out outside peak usage times where possible. FamPrio reserves the right to further develop, change or discontinue features, provided this is reasonable for users.

§ 10 Liability

FamPrio is liable without limitation for intent and gross negligence. In the case of slight negligence, FamPrio is only liable for breaches of essential contractual obligations (cardinal obligations), and then limited to the foreseeable damage typical for the contract. Liability for the loss of data caused by the user themselves is excluded, provided FamPrio has taken the necessary data backup measures.

§ 11 Data portability and switching providers

You can export all data entered by you and your family yourself at any time — in a structured, common and machine-readable format (JSON) and additionally in an easily readable version (PDF/HTML). You trigger the export directly in the app under „Settings → My data“. With this we fulfil your right to data portability (Art. 20 GDPR) and the requirements of the EU Data Act (Regulation (EU) 2023/2854) on switching providers.

We do not charge any fees for the export or a switch to another provider, and we do not set up any technical barriers. This way you always stay in control of your data and can leave FamPrio without losing any data.

§ 12 Applicable law and place of jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, the mandatory protective provisions of the country in which the consumer has their habitual residence apply. The place of jurisdiction for merchants and persons without a general place of jurisdiction in Germany is Lippstadt.

§ 13 Dispute resolution

FamPrio is neither obliged nor willing to take part in a dispute resolution procedure before a consumer arbitration board.

§ 14 Severability clause

Should any provision of these T&C be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by a rule that comes closest to the economic purpose of the invalid provision.
